Our service members deserve better!  In July 2018 3M agreed to pay the US government 9.1 million dollars for knowingly selling defective earplugs that were used by our service men and women between 2003 and 2015.  These defective ear plugs are believed to have lead to a significant increase in the development of tinnitus or ringing in the ears, hearing loss, permanent hearing damage and even deafness.

Did you wear 3M Combat Ear plugs?   The dual ended earplugs were designed to protect from close range fireams and other loud impact noises.  The company alleged that with two different ends, yellow and black/olive the earplugs offered the option to either block all sounds or only hear low level sounds such as verbal commands while blocking out loud bang noises.  But due to their defective design, the earplugs can loosen and move out of the ear canal enough to allow hearing damage.  Despite knowing about this defect and the damage that it could cause 3M continued to sell them to the US Military for use by our soldiers.

What do you need to know to determine if you have a potential claim?

  • Did you have no hearing loss or tinnitus upon your entry medical exam into the military?
  • Did you serve abroad in Afghanistan or Iraq between 2003 and 2015?
  • Were you diagnosed with tinnitus or hearing loss upon deployment return when a medical exam was performed?
  • Were you diagnosed with tinnitus or hearing loss upon your final medical exam upon retirement?

What is the status of the litigation?

Currently all cases are in front of Judge Casey Rodgers in Pensacola, Florida in federal court.  There are currently about 2800 lawsuits filed, including by the attorneys at Keith Law Group, on behalf of service men and women.  According to a recent court census it is expected that nearly 140,000 individuals nationwide have indicated that they have claims as a result of this defective ear plug.
